Introduction to the Canadian Trademark Registration System​

  1. ​Since Canada has not joined the Madrid System, your trademark protection can only be applied if you submit a trademark registration application to the Canadian Trademark Office.

  2. In Canada, if a precious metal product is marked with a quality mark, the trademark of the precious metal product must be registered.

  3. The trademark protection period in Canada is 15 years from the date of registration. After the renewal fee is paid, it can be renewed continuously for another 15 years.

  4. For three consecutive years without proper reasons to use the registered trademark, the Trademark Office may revoke the trademark registration or under the request of any third party.

Can we apply for a “scent” trademark in Canada?

No. At present, Canada has not yet opened special trademark registrations such as scent, animation, and hologram. Trademarks can include text, sound, graphics and combinations.
